Official Raffle Rules & Regulations

The 2018 Sail on San Francisco Bay Raffle is a fundraising activity conducted by the Ardicare Foundation, a tax exempt organization under Section 501(c)3 of the U.S. Internal Revenue Code and is conducting this raffle pursuant to California Penal Code Section 320.5, et seq., to raise funds for charitable purposes to fund an implementation of the Community Self-care Demonstration program in the San Francisco Bay Area.

These Official Contest Rules and Regulations may not be waived, modified or supplemented except by the Ardicare Foundation. No modification of these official contest rules shall be enforceable unless made by the Ardicare Foundation.

By participating, you agree that these Official Rules and Regulations govern the conduct of the Sail on San Francisco Bay Raffle and, together with the decisions of the Ardicare Foundation, are binding on everyone who purchases a raffle ticket and/or who is named on a raffle ticket. By purchasing a raffle ticket the purchaser agrees to be bound by these rules and regulations. Ardicare Foundation’s interpretation and application of the rules and regulations shall be final.

DRAWING: The drawing for a the Sail on San Francisco Bay, sponsored by SailTime San Francisco, will be held at the Artseed offices at the Tides Converge Building, 1007 General Kennedy Ave. Suite #206, in the Presidio of San Francisco at approximately 7pm on Thursday May the 31st 2018.

The Drawing Date and all other dates stated in these rules may be extended at the Ardicare Foundation’s absolute discretion. One winner will be selected (“Winner”).

The prize drawing is open to the public, and the winner need not be present to win. There will be additional drawings for various prizes including but not limited to artwork donated by Artseed, keepsakes from Haiti and South Africa offered by the Ardicare, tote bags, etc.

The price per ticket is $10.00.

The Ardicare Foundation and its representatives will make reasonable efforts to contact the person named on the winning raffle ticket stub, using only the information on the winning raffle ticket stub form.

Winner’s name will be posted on website (www.turningthetideoftrauma.org) with instructions on how to contact the Ardicare Foundation to claim the Prize.

If, despite these efforts, the person named on a winning raffle ticket cannot be located after reasonable efforts by the Ardicare Foundation, or if any such person is ineligible under these rules or applicable law, then that person will not be awarded the Prize and another Winner will be selected. The winning ticket will be drawn at random from a receptacle containing all eligible raffle ticket stubs.

ODDS: A maximum of 500 tickets will be sold. Odds of winning is 1:500 if all tickets are sold. Ticket sales will cease when that number of qualified entries is reached. Tickets will be sold beginning on January 31, 2018.

Tickets will not be sold after 6:00 p.m. on the Drawing Date. Tickets may sell out before that time.

TAXES AND IRS RULES: The IRS position is that amounts paid for chances in raffles, lotteries, or similar drawings for valuable prizes are not gifts, and consequently do not qualify as deductible charitable contributions. The Ardicare Foundation, and the event sponsors, Think Round Inc., Artseed and the Western Institute for Social Research, assume no responsibility for the Winner's tax and/or legal obligations and suggests the Winner consult his/her tax and/or legal advisor.

The total price/value of the Prize is $800 and the Winner assumes all income tax, sales tax, registration fees, and any other fees. Winner is responsible for the completion of all documentation required by SailTime, the sponsor of the Sail on San Francisco Bay.

WAIVER/LIMITATIONS OF LIABILITY: By participating in this raffle, all ticket purchasers and everyone named on a raffle ticket accept and agree: (1) to be bound by all the rules, limitations and restrictions set forth herein; and (2) that their names and/or likenesses may be disclosed to and used by the news media and may otherwise be used by the Ardicare Foundation, Artseed, The Western Institute for Social Research or by SailTime San Francisco for publicity purposes in area newspapers or other media including other print venues, television, radio, and online, including their websites.

The Ardicare Foundation interpretation and application of the rules and regulations shall be final. By participating in this raffle, each participant releases the Ardicare Foundation, Think Round Inc., Artseed, the Western Institute for Social Research, and SailTime San Francisco and each of its affiliates, directors, officers, employees, owners, and agents from any and all liability for injuries, losses or damages of any kind caused by any prize or resulting from acceptance, possession, use or misuse of any prize, and each winner agrees to indemnify and hold Ardicare Foundation, Think Round Inc., Artseed, the Western Institute for Social Research, and SailTime San Francisco and each of its respective directors, officers, employees, and agents harmless from any and all losses, damages, costs, expenses, rights, claims and actions of any kind arising in connection with or as a result of the winner's acceptance or use of the Prize.

ELIGIBILITY: Raffle ticket purchasers and the person named on a raffle ticket must be at least 18 years of age at the time of purchase. Raffle tickets may not be purchased in the name of a business, trust, corporation, or other entity, or wherever prohibited by applicable law. Winner must have capacity to contract.

CLAIMING THE PRIZE: Winners’ name will be announced on the Drawing Date by posting on the Turning the Tide of Trauma website “News” blog. Winner to follow instructions on posted announcement.

REFUNDS: All raffle ticket sales are final. No refunds will be made. The Ardicare Foundation, Think Round Inc., Artseed, and the Western Institute for Social Research (WISR) assume no responsibility for lost or stolen tickets. A raffle participant's sole and exclusive remedy for the Ardicare Foundation’s breach shall be limited to the return of the purchase price paid for his or her raffle ticket(s). In no event shall the Ardicare Foundation, Think Round Inc., The Western Institute for Social Research or its respective directors, officers, employees, members, committee members, agents, contractors, advisors, or representatives be liable to any party for any loss or injuries to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity under any circumstances.

TICKETS: Tickets are $10.00 each, payable by cash or check made payable to The Ardicare Foundation, and may be purchased solely from Ardicare Foundation, Think Round Inc., Artseed, or WISR representatives starting on January 31, 2018 until sold out or until 6 p.m. on the Drawing Date. You may buy as many tickets as you wish, subject to availability. Raffle ticket can be purchased in one name only. Each raffle ticket will be entered separately in the drawing. Each raffle ticket is a separate and equal chance to win the Prize. The prize, a Sail on San Francisco Bay and any related tax liability will belong to the person named on the ticket. All sales transactions are final. The Ardicare Foundation with cooperation Think Round Inc., Artseed, and WISR will retain the ticket stubs securely for the drawing.
